1. The ‘Terms of Use’ and the ‘Privacy Policy’ as contained on the website, shopcherries.com (a Website run by the Shopcherries Marketing Pvt.Ltd herein after referred as “Company” ) are to be treated as part and parcel of the present terms and conditions, to the extent the same are not in contravention to them. The customer is requested to read the’Terms of Use’ and the ‘Privacy Policy’ before participating in this “Live your FORD ECOSPORT Dream” which is in the nature of a Live your FORD ECOSPORT Dream. The terms ‘User’/ ‘You’ used therein is to be read for the purposes of this Live your FORD ECOSPORT Dream as ‘customer.’
2. Only an Indian citizen who is 18 years of age shall be entitled to participate in this Live your FORD ECOSPORT Dream. Persons below 18 years of age can participate only through his /her legal guardian.
3. Live your FORD ECOSPORT Dream contest is only applicable / valid only on the orders received and accepted.
4. The Order invoice copy is to be preserved by the customer till the mega draw of “Live your FORD ECOSPORT Dream contest” is over.
5. The products you choose from our website are for personal use only and not for any other commercial purpose/ re-sale. If customer has any issue regarding the order or contest T & C , he / she should contact Shopcherries Customer within 15 days on the receipt of the order. 7. In relation to the exchanged/replaced order, Shopcherries Marketing Pvt Ltd(‘Company’) shall not be responsible if the order(along with the new Order invoice copy) does not reach the desired address by the cut-off date of receiving the Order invoice copies for the mega draw.
8. The mega draw / winner announcement of FORD ECOSPORT and the other respective prizes shall be held on 28th Dec 2014 at Delhi . The result shall be displayed on the same day on the Website or latest by 31st December 2014.
9. The Company, the operators of the Website, reserves the right to terminate this offer or any part thereof at any time without assigning any reason, if it is found that the customer has in any manner violated the Terms of Use, the Privacy Policy the present terms and conditions or for any other reason.
10. Live your FORD ECOSPORT Dream contest is for the benefit of the Company’s customers and no extra value in whatsoever form is charged from the customer for and on participation . Also please note that company is not running any cash laundry / lottery scheme , so please refrain yourself from making any payment if Sales executive does any miscommitment regarding the same as Shopcherries won’t take any responsibility for such transactions. Also the company Shopcherries Marketing Pvt ltd does not take any guarantee if the customer has shared his/her confidential personal or financial details with any employee of Shopcherries.com .
11. No inquiries shall be entertained by the Company regarding the winners list. Incase you have any issue with your order or contest participation you can cancel your order within 15 days of your order date , post that no refunds / cancellations shall be entertained. Cancellation charges are 20% of the Order Value .
12. The Company shall be at its sole discretion to award the prize/s to some other person, in the event the declared winner for that prize/s fails to arrive at the venue on the stipulated date and time, as intimated by the Company. This decision of the Company cannot be challenged by the original winner or any one on his/her behalf, before any court/tribunal/forum/authority.
13. The winner shall be liable to pay all applicable taxes/charges/levies/duties/excise on the gift won by him/her and shall accept the delivery at his/her cost and expense.
14. A) All disputes, differences or issues of whatsoever in nature between the Company and Customer shall be referred to the sole Arbitrator appointed by the company as per the provisions of The Arbitration and Conciliation Act, 1996
B) All disputes are subject to the exclusive jurisdiction of competent courts and forums in New Delhi only.
15. The Company shall not be responsible for postal delays, transit losses or mutilation of the parcel.
