Idea Music Station Recharge Contest For Madhya Pradesh Circle 2014 :
This Contest is purely on a “best effort” basis and participation is voluntary for the eligible Subscribers of Idea Music Station Service (the “Service”). SPICE DIGITAL LTD in association with Idea Cellular Ltd, reserves the right to participation in this Contest.

Term / Offer or Contest Period :
This Contest is open for a limited period only from 12 Apr 2014 at 00 :00 hrs to 11 May 2014 at 23:59:59 hrs (“Contest Period”).

Eligibility Criteria :
** The Contest is open for active pre-paid category of cellular subscribers of Idea Cellular Ltd , in telecom circle of Madhya Pradesh & Chhattisgarh (“MP & CG”) only (the “Subscribers”). For the sake of clarity, a “Subscriber /Participant” for the purpose of this Contest shall mean and include an individual/person, who is the rightful owner/user of the pre-paid mobile connection of Idea Cellular Ltd, registered in MP & CG telecom circle and in whose name the mobile connection is active and registered as per the records maintained by Idea Cellular Ltd (and which shall be conclusive). In case a Participant is an employee of a company and the mobile connection used by him is registered in the name of an employing company, the employee /user can participate in the Contest provided that the employing company issues a letter to this effect certifying that the particular employee/user has been allotted the specific mobile connection, and intended to be used by the employee for participating in the Contest. The employees of Idea Cellular Ltd & Spice Digital Ltd and their group companies affiliate or associate companies; are not eligible to participate in this Contest.
** This Contest is not available to the Subscribers roaming in other telecom circles of Idea Cellular Ltd and also not available to Idea Cellular Ltd roaming subscribers (of other telecom circles), roaming in the above said telecom circle, wherein Contest has been made.
** Any postpaid Subscriber shall not be eligible to participate in this Contest.
** In order to be eligible for this Contest, a Subscriber/Participant must fulfill the following criteria-
** He/She should be above 18 years of age.
** Hershel must be citizen of India.
** He/She must not have any criminal record nor should be of an unsound mind.
** He/She must not be restrained by any law of the land (e.g. – any court order(s) etc.).
** He must be either an active existing or new subscriber of Service during the Contest Period.

Participation :
This Contest is purely on a “best effort” and is meant for voluntary participation by the existing and new subscribers of Idea Cellular Ltd MP & CG Circle. Moreover, this Contest is PPU based Contest wherein each Participant have to listen more & more Cricket Score & Trivia, while participating in this Contest. To participate in this Contest, a Subscriber/Participant shall have to follow the following-

Customer needs to Dial short code 543213 as IMS Active User or 57777 and have to generate more & more Minutes of Usages (“MOUs”) on Idea Music Station , shall become eligible for participating in this Contest and have the chances to become winner of the Gratifications (as mentioned in clause 4).

Applicable Charges :
(i) Subscription charges for the IDEA MUSIC STATION Services is AT Rs. 36/- per month.
(ii) Call Charges of 57777 is Rs 6.99/min

Selection of Top Performer(s)/Highest Scorer(s) :
Participant(s) (543213Active User or 57777 Pay Per Use User) having the maximum MOU shall be selected as winner.

Out of all the Subscribers/Participant, who have generated maximum MOU, will be declared as Winner and will be eligible for the Gratification/ Prize as mentioned in clause 4. In case of tie between the two or more Participants i.e. if two or more Participants have equal MOU, then the Participant who has the maximum Calls while using the service, shall be selected by Idea Cellular Ltd / SPICE DIGITAL LTD for Gratification as per below. It is also specifically agreed by the Participants / Subscribers that the decision of SPICE DIGITAL LTD and/or Idea Cellular Ltd with regards to the Contest including the process for selection of the Winners shall be final and binding upon them and agree not to dispute, or seek any clarification for the same from either SPICE DIGITAL LTD or Idea Cellular Ltd 5or both

Gratifications/Prizes :
Top Participants who have generated maximum Score During/at the end of the Contest Period shall be selected by SPICE DIGITAL LTD in accordance with clause of the T&C, and shall be bequeathed as follows
(Note- IMS Recharge Contest gratification paid by Spice Digital Ltd)
(Total 4) Top 4 Performer with Rs 2500 Recharge each(4 Winner, Highest MOU Customers in 30 Days),
(Total 4)Top 2 Performer in Every 15 Days with Rs 1500 Recharge each(4 Winner ,2 Highest MOU Customer in Every 15 Days(2 in First 15days and 2 in last 15 days) ,
(Total 8)Top 2 Performer per week with Rs 1000 Recharge(8 Winner, 2 Highest MOU Customer Every Week)
(Total 120) Apart from the above daily 4 Participants who will generate maximum MOU in a day during the Contest Period will get Rs 150 recharge each.

** It is understood and agreed by the Subscribers/Participants that mere participation to this Contest during the Contest Period, does not entitle the Subscribers/Participants to claim the Gratification. He /she should be a selected/ declared Top Performer/Winner by SPICE DIGITAL LTD in conformity with the terms of clause 3.3, to claim the Gratification(s) mentioned above.
** It is understood and agreed by the subscribers/Participants that a selected Winner/ Top Performer shall have to be the rightful owner of the particular mobile phone number/ connection, registered as per the records maintained by Idea Cellular Ltd (and which shall be conclusive). If the selected Top Performer/ Winner is not able to provide sufficient evidence to show that he/she is the rightful owner/user of the particular mobile connection, Idea Cellular Ltd reserves the right to award the Gratification to the next eligible Top Performer/Winner.
** By participating in the Contest, the Subscriber/Participants hereby further understand and agree that SPICE DIGITAL LTD shall at its sole discretion be responsible for inter-alia the selection of the Winners and delivery of the Gratification at the mentioned venue of the choice of Idea Cellular Ltd & SPICE DIGITAL LTD. The decision of SPICE DIGITAL LTD in this regard shall be final and binding upon the Subscriber/Participant.
** The Winners shall be intimated through Idea Cellular Ltd. The Subscribers/Winners are required to be vigilant on their part in gathering information regarding the selection of Winners and/or for collection of Gratification. The date and time of selection of Winner shall be within 7 working days from the date of the closure of the Contest and the information shall be uploaded on the website as aforesaid, after the closure of the Contest. The Subscriber/Participant hereby understands and agrees that Idea Cellular Ltd’s responsibility in the Contest is limited only to the extent of communicating the list of Winners to SPICE DIGITAL LTD .It is specifically mentioned that no information by post/courier/fax/telegram or any other mode shall be given by the SPICE DIGITAL LTD.
** At the end of the Contest Period and after the declaration of the Winner/Top Performer by SPICE DIGITAL LTD/Idea Cellular Ltd, The Participant who have been declared Winner/Top Performer and who have won the Gratification as per clause 4 of the T&C, shall be entitled to claim the Gratification from Idea Cellular Ltd’s Circle Office situated at MP (the “venue”). SPICE DIGITAL LTD / Idea Cellular Ltd shall not be responsible for the travel arrangements and/or any cost incurred by any of the Winner for the collection of their respective Gratification.
** The Participants including the Winner understand and agree that acceptance of the Gratification by the Winner, constitutes grant of permission to Idea Cellular Ltd as well as SPICE DIGITAL LTD and its affiliates, to click photographs of the Winner and use the Winner names, photocopy, preferences (likes and dislikes), voice and comments for adverting and promotional purposes in any media worldwide, only for purposes of advertising and trade without any additional compensation whatsoever to the Participants. The Subscribers/Participants including the Winners, hereby understands and gives his/ her irrevocable consent for sharing /submission of his/her personal information with SPICE DIGITAL LTD.
** SPICE DIGITAL LTD / Idea Cellular Ltd does not guarantee the quality of the goods/ services being Contested as Gratification nor is liable/ responsible for any defect or deficiency of goods or services so obtained/availed, by the Subscribers/Participant under this Contest. SPICE DIGITAL LTD / Idea Cellular Ltd shall also not be liable for any defect/ deficiency in the Gratification so Contested to Winners under this Contest.
** The Participants including the Winner understand and agree that the Gratification under the Contest is neither assignable nor transferable under any circumstances. The Gratification shall be subject to such other terms and conditions as may be applicable to specific Gratification and shall have to be duly complied with by the Winner.
** The participants including the top scorer understand and agree that the value of the gratification will attract tax deduction at source as per applicable laws. Therefore successful Subscribers will receive the Gratification after deduction of all applicable taxes thereon. The Top Performer / winner will be provided with an appropriate TDS certificate by SPICE DIGITAL LTD in respect of the amount of tax deducted from the gratification money.
** This selection shall be final and binding upon the participants.

All Gratifications must be claimed by the Top Performers, along with the documents specified herein below at the venue of the event.

The documents required to be submitted along with the claim by the Winner include the following:
** Identity Proof
** Address Proof
** PAN Card and
** Letter of Compliance with rules and regulations

(The document list is only inclusive and not exhaustive and can change as per the requirements of Law)

The Gratification(s) to the top scorer shall be given subject to compliance with all applicable statutory legislations/ processes /formalities in connection with the Gratification(s) and on production all such documents/papers mentioned in clause 15 of this T&C and as required by Idea Cellular Ltd / SPICE DIGITAL LTD before accepting the delivery of the Gratification. Any failure on the part of the Winner to comply with directions issued by Idea Cellular Ltd / SPICE DIGITAL LTD for claim of Gratification shall entitle Idea Cellular Ltd / SPICE DIGITAL LTD to forfeit the Gratification.
