Terms and Conditions of “Sunland Sunflower Oil” Contest :
1. Sunland Sunflower Oil Contest for consumers hereinafter referred as “Contest”.
2. KTV Health Food Pvt. Ltd. hereinafter referred as “KTV”
3. The consumers can participate by sending a SMS to 9843000777 with the unique code printed outside the Sunland 1 Ltr. Pouch, 5 Ltr. Can, 15 Ltr. and 15 Kg. Tin.
4. Winners will be selected at the end of the Contest and all shortlisted winners will be eligible to receive any of the following prizes,subject to terms and conditions.

Agreement to Terms and Conditions :
1. The participant in Contest by SMS and online participation agree to the terms and conditions contained in www.sunlandoil.in which is the Contest website. The participants are bound by the decisions of KTV which is final and binding on all the contestants.
2. KTV reserves the right to eliminate any person from the contest in their opinion considered to be having conflict of interest or unfit.
3. KTV reserves the right to terminate, modify or extend the Contest at any time at its own discretion without assigning any reasons whatsoever.
4. The decisions of KTV in respect of the Contest and Prizes therein will be final and absolute and not open to any scrutiny or interference.

Eligibility :
1. This contest will be open to Indian residents excluding agents, Distributors, retailers and any other channel partners of KTV.
2.Minors below the age of 18 yearscan also participate with their parents or guardians with the documentary evidence to prove the relationship. In that case they may redeem the prize at his / her own cost and shall execute the documents as required.
3. To receive the High Value prizes, the participants must furnish the bank account details and PAN card details (Permanent Account Number) and ID proof & address proof.
4. The successful participants must produce original Sunland 1 Ltr. Pouch or 5 Ltr. Can or 15 Ltr./ 15 Kg. Tin for verification and redemption of prizes.
5. KTV or its agency will not be responsible for any NDNC (National Do not call) Registry regulation that will come into play. Participants will agree as per the terms and conditions under NDNC, DND (Do not Disturb), KTV or its agency will have all authority to call such participants who voluntarily participate in the SMS campaign.
6. The Participants individually be referred to as” Participant” and collectively as “Participants”
7. Employees, Directors and their Kith &Kin from “KTV Health Food Private Ltd” are not eligible for participation.

Contest Period and Contest Timings :
1. The Contest Period commences on January 14, 2014 and ends on 30th May, 2014 hereinafter referred to as ‘Contest Period’. The Contest is valid only on Sunland 1 Ltr. Pouch, 5 Ltr. Can, 15 Ltror 15 Kg. Tin Packs and not for any other packs.
2. Only entries with correct Code No.(Taken from the Sunland Pack bought from the market with a valid bill) must be sent as SMS to the given telephone number for consideration as valid for participation in the contest.
3. The time of participation will be defined as the time at which the entry is received through SMS.
4. The manner of selecting the winning entry is described under the Clause of “Winner Selection”. Participants will be chosen during the Contest Period. Participants will be chosen by a skill based selection (slogan contest), supervised by an authorized officer. Details on the Winner Selection are mentioned under the Clause of Winner Selection.

How to apply :
To participate in the contest, consumers must purchase Sunland 1 Ltr. Pouch, 5 Ltr. Can, 15 Ltr or 15 Kg. Tin and look for the unique code printed outside the pouch/label. SMS or email slc AT sunlandoil.in is the only route to participate in this Contest.

The SMS route :
i. As a first step,Participants are required to SMS the Unique code printed outside the Sunland 1 Ltr. Pouch, 5 Ltr. Can, 15 Ltror 15 Kg.Tin to 98430 00777 from any GSM or CDMA mobile phone.
ii. Participants will receive a confirmatory pre-recorded voice call and an SMS with the question to be answered. The participant must reply with the answer by return SMS.
iii. If an SMS is received from a consumer after completion of the Contest Period, the Participant will receive a message informing him / her of the Contest being over and the entry will not be considered.
iv. The participant shall have to pay charges to their respective telecom service providers for sending the SMS.
v. If the Participant sends an incorrect or invalid code, participant will be asked to resend the correct unique code. Otherwise the entry will not be entertained.
vi. Only one person can Contest under one valid unique code taken from the Sunland Pack (i.e. Only a single SMS entry for contest will be entertained). Multiple SMS entries sent under single valid unique code will automatically be rejected.

Winner Selection :
1. KTV will select the winners from amongst the slogans sent by the participants via SMS (or) email: slc@sunlandoil.in.
2. The best slogans will be selected by KTV based on the creativity of the slogan.
3. KTV’s selection of slogans and winner will be final and binding on all participants.
4. No review or enquiry into the selection process of the winners will be entertained.
5. KTV reserves all rights and discretion for selecting the slogans fit for winning.

Contacting winners :
1. Once the Winners are shortlisted, the Agency appointed by Sunland shall call each on the number from which the SMS has been sent or indicated whilst making an online entry.
2. In the event the shortlisted Winners mobile phone number is busy, unreachable, or he/she does not attend the call, two (2) more attempts will be made to reach the Winner on that day and/or the next day. If even on the third attempt, the Winner does not attend the call, or is unreachable, the Winner’s participation in the Contest will come to an end and the Winner’s entry stands cancelled and Winner becomes ineligible to receive any prize.
3. If any shortlisted Winner remains unreachable on the third attempt, he/she cannot claim the prize thereafter.
4. In case of positive response the shortlisted Winner will be required to send the following documents.
i. The Sunland Pouch/Label bearing the code that was entered as SMS by the consumer in the entry via any of the modes of participation.
ii. In case of major prizes, self attested copy of following documents for the purpose of taxation and legal validation must be provided to claim the prize.
iii. Income Tax Permanent Account Number.
iv. Photo identity proof (e.g. Driver’s license, Election card (Voter ID), Passport and any other document issued by the Government of India)
v. Address Proof (Electricity Bill, mobile bill, passport and any other recognized document that may pass for Address proof)
vi. Bank account details (passbook, cancelled cheque etc.)
vii. Any other document as may be required. This will be referred to as Participation Package.
viii. The completed Participation Package needs to be sent only by registered post with Acknowledgement Due to the address mentioned below so as to reach within 15(FIFTEEN) days of the call made by the agency to the selected winner.

xi. If the shortlisted Participant, for Major prizes, does not have a PAN card, he/she will be provided 15(FIFTEEN) days within which he/she must apply for a PAN card and ensure that an attested copy of the same, along with all the documents to the address mentioned above and ensure that it reaches the Agency.
xii. If the Agency does not receive the Participation Package from any shortlisted Winner within the stipulated time period, the agency shall call the Winner on the given contact number, reminding them to ensure that the Participant Package reaches the Agency within 10(TEN) additional days. If the shortlisted Winner is unable to send the same in the stipulated time, he / she will be forfeited of the prize.
xiii. The cost and expenses of postage shall be borne by the Winner himself. KTV or the agency shall not be responsible for any accident or mishap or loss of the package by the Winner in transit. The responsibility of ensuring that the package, reaches the address as directed by KTV or its Agency lies solely with the Winners.
xiv. In the same call, the shortlisted Winners will be told that in case they are verified upon scrutiny of all documents received in the Participation Package, they will be required to send a Demand Draft (Hereinafter referred to as DD) for the applicable TDS as per prevailing laws and regulation depending on the value of the major prizes.
xv. If the shortlisted winners sends incomplete documents, the agency shall call the shortlisted participant on the given contact number, requesting for complete documents and shall provide 10(TEN) additional days for submission of complete set of documents.
xvi. If complete documents sets are still not received within the additional 10(TEN) days provided the shortlisted winners, the prizeswon by them will stand forfeited and his / her participation in the Contest will then be null and void.
xvii. No justificationand/or explanation for non-receipt of the Participation Package or any missing documents shall be accepted.
xviii. On receipt of the Participation Package, KTV and/or its Agency shall scrutinize all contents. If all the document and contents are in order and the unique code entered by the participant whilst participating in the SMS contest matches with that on the Sunland Sunflower Oil wrapper submitted by the winner, the participant will then be treated as a Validated Winner upon approvals from KTV.
xix. If KTV or its Agency does not receive the DD from any shortlisted participant within 10 days of informing that it needs to be submitted, the shortlisted participant will be contacted on the number from which the participation was made / spoken to the first time and reminded that he / she has to sent the above Package within an additional 10(TEN) days.
xx. The prize will be dispatched / handed over / transferred to the Confirmed Winners after the above formalities are successfully completed.
xxi. No prize will be awarded to the Winner if the information presented by the Participant(s) at the time of entering the contest and the Participation Package is not factually correct.
xxii. The prizes to shortlisted Participants shall be given subject to production of all such documents, papers and information as required by KTV and/or its Agency. Apart from the announced prize, the shortlisted Participant/Validated Winner/ Confirmed Winner or his / her legal heirs will have no other rights or claims against KTV.

General Conditions :
1. Each Participant represents and warrants that he/she is legally competent to enter into binding contracts under applicable laws. By taking part and/or entering into the contest the Participant warrants that all information provided by Participant regarding Participant’s name, age, state, city, address, phone number, etc. is true, correct accurate and complete.
2. Each Participant is required to provide full and accurate details of his/her name, permanent address, Income Tax PAN, phone number, age and such other details as may be prescribed by KTV and it is to be understood that the prizes will be given to the winner only upon furnishing of the prescribed details and documents to the Agency or the courier (as applicable).
3. The decision of KTV or its Agency, as regards the selection of winners and distribution of the prizes is final, subject only to KTV’s approval. No correspondence or any other claims whatsoever, in this regard will be entertained.
4. KTV reserves the right to check all KTV wrappers for their authenticity and reject them if not found genuine and/or manufactured by them.
5. The prize cannot be exchanged, and is not transferable and cannot be converted into cash.
6. The agency shall provide the prize on an “as-is-where-is” basis and without any warranty / or guarantee concerning the quality, suitability or comfort, and KTV and/or its associates, affiliates and/or its management, directors, officers, agents, representatives shall not be responsible for or liable (including but not limited to the product and service liabilities) for deficiency /and/or defect of any product/service and/or the prize or for any kind of consequential damages/loss in any manner whatsoever, if any Participant has any grievance with respect to the prize, he/she may directly contact the manufacturer / builder.
7. If the winners do not provide the agency and/or the courier (as required) withvalid documentary proof in relation to their age and parents/guardians consent, their participation shall unconditionally and irrevocably lapse without further notice in this regard.
8. KTV reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of KTV in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final, binding and non-contestable.
9. Nothing contained herein amounts to a commitment or representation by KTV to conduct further Contests.
10. The decision of KTV shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant/Winner and KTV and the Participant/Winner shall not have any authority to bind KTV in any manner whatsoever.
11. KTV or any of its respective officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible original documents and/or photocopies and that of Sunland Sunflower Oil wrappers etc.
12. KTV or its Agency shall not be liable to perform any of its/their respective obligations under the Contest or in respect of the prize where it is unable to do so as a result of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition or act of god etc., and shall not be liable to compensate the Participant/Winners under these circumstances, KTV shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any state, central government restrictions, laws and regulations that may be in existence or come into force.
13. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of KTV or its Agency.
14. KTV accepts no responsibility for late, lost incomplete, incorrectly submitted, delayed illegible, corrupted or misdirected entries, loss of SMS , loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alternation, tampering, unauthorized data hacking, deletion, theft, destruction virus attack, transmission interruption, communications failure, hardware failure or otherwise, KTV shall not be liable for any consequences of user error including (without limitation) costs incurred.
15. KTV will not accept any Sunland Sunflower Oil wrapper from the winner without the unique code printed on it or is damaged or has been erased or has become illegible or found to be in duplicate
16. Proof of messaging, calling and making an online entry is not proof of receipt of the SMS, call or the online entry.
17. If a Participant is dissatisfied with the Contest or the Contest rules and/or any content or any requirements of the contest form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Contest.
18. KTV will bear the only the gross cost of the 2BHK Flat. The winner must bear all other costs pertaining to the flat vis-à-vis Registration Charges, Stamp Duty, EB Connection Charges, Water Connection Tax, Service Tax, VAT etc.
