VIJAY TELLY AWARD: VOTING ACTIVITY (POLL)’ will be held on VIJAY (“Channel”) as stated hereunder:
1. The Poll shall commence from 6th May 2014 at 11:00 hours and would be open until 23:59 hours on 22nd May 2014. The Channel reserves the right to modify the time line at its sole discretion at any later date. However the modified time lines will be notified to the viewers in the revised Rules governing the Poll which will be uploaded in the Channel’s website.

2. During the Poll, the Channel will telecast the names of the nominees under various categories morefully detailed below everyday from May 6, 2014 at 11:00 hours. Vijay Television Private Limited (“VTPL”) and/or the Channel reserve the right to change the dates, the timings and days of the telecast of names of the nominees, without giving prior written intimation to the viewers.

3. For the below mentioned categories a viewer can vote exclusively through online. The list of Nominees for each of the Categories mentioned below shall be available in website

4. The viewers by participating in the Poll will get an opportunity to cast their vote in favour of any of their favourite Artist/Show.

5. A viewer interested in casting their vote for choosing their favorite category of Artist/Show, could follow either of the steps stated herein below:

5.1 SMS- A viewer choosing to vote in a particular category must SMS the category code (A/B/C/D/E/F) and send to 57827. In return the viewer will get a reply message with the numbers allotted to the nominees under that category to enable the viewer to choose his/her favorite Artist/Show Only SMS sent in this prescribed format will be counted as a valid vote and others will be rejected. No disputes will be entertained in this regard. SMS sent through Aircel and BSNL Mobile Operators will not be considered for voting.

5.2 IVRS: The subscribers of Airtel, Vodafone and Tata Docomo can only participate in Poll conducted through IVRS. The Viewer can Dial 5782701 from their respective mobile phones and follow the instructions of the recorded voice.

5.3 Online Voting: Log on to www.vijaytv.com and follow the instructions stated on the website.

6. The cost charged to the viewers by the mobile operators for voters will be as follows:
6.1 For SMS: Each SMS shall be charged by the respective mobile operators at the rate of Rs. 3/- per SMS. For Vodafone, Idea, Tata, Reliance, Airtel ROI (Rest of India) and Rs. 5/- per SMS for Airtel TN & Chennai.

6.2 For IVRS: – Each IVRS shall be charged by the respective mobile Operators as follows Operator per minute cost Rs.
Airtel 5
Vodafone 10
Tata Docomo 6

6.3 The cost of each SMS and IVRS shall be charged by the respective operators. Neither VTPL nor the Channel shall be responsible in case of any network problem and/or the costs charged by the mobile operator or breakdown of the machinery or any other default or problems which may occur due to the voting mechanism or any problems in connection thereto. VTPL shall not be responsible for any dispute in connection to the same and all disputes in this regard should be settled directly between the subscriber and the respective mobile/landline operator without involving VTPL and/or the Channel.

7. Vote(s) sent after the time period stated herein above shall not be considered and shall be null and void.

8. The winner of the VIJAY TELLY AWARD shall be based on votes received from the viewers and the decision of Vijay TV Panel. The weightage assigned to votes received and the decision of Vijay TV panel shall be equal, i.e; 50: 50.

9. The viewers can send any number of entries to choose their favourite Artist/show by casting their vote as much as possible without any cap.

10. The winner of various categories mentioned in Rule 2 and Rule 3 of Vijay Telly Award shall be determined based on the weighted average score of both votes received from viewers and the views made by the Channel. Nominees having the highest score shall be declared as winner of that particular Category. The declaration of the Channel on the winner shall be final and binding.

11. It is expressly stated that this is simply a Poll to enable the viewers to choose their favorite Artist/Show under different categories mentioned in Rule 2 and Rule 3. Therefore, there shall be no winners declared or Prizes distributed for participating in this Poll.

PART B- GENERAL RULES :
1. VTPL or the Channel reserves all rights to make amendments to the existing rules without prior notice.
2. The viewer interested in participating in the Poll must be above the age of 18 years and a resident of India. The viewer interested in participating in the Poll who are not resident of India, then they can vote through Online alone.
3. The voter(s) of the Poll agree that he/she shall hold harmless the Channel, VTPL, its employees, officers or any other person in relation to any injury/damage/harm/loss suffered by him/her, in any manner, whatsoever in connection with the Poll and shall also not file in person/ through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum in India against the sponsor and/or the Channel and/or VTPL to claim any damages or relief’s.
4. The Channel and/or VTPL is in no manner whatsoever responsible and/or shall not be held liable in any manner whatsoever, for any injury, death, mental trauma caused to the voter in any manner whatsoever, in connection to the Poll.
5. Employees of the Channel, VTPL, and the members of their immediate family, persons with criminal convictions, persons other than citizens of India, are ineligible to vote and be part of the Poll.
6. The participation of the viewer(s) in the Poll shall mean that the viewer (s) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Poll.
7. The outcome of the Poll/the decision made by the Channel and/or VTPL regarding the Poll shall be final and binding on the viewers and in no event shall the viewer/voter dispute the decision made by VTPL, Channels and/or its employees in connection to the Poll.
8. The terms of this rules and regulations shall be construed in accordance with the laws of India and incase of any dispute or other matter arising in reference to the Poll shall be referred to a sole arbitrator appointed by VTPL and shall be governed by the Arbitration and Conciliation Act, 1996, amended from time to time. The venue for arbitration shall be Mumbai, in English language. The costs, charges and expenses in connection to arbitration shall be solely borne by the viewer(s) disputing. The arbitrator’s award shall be final and binding on the parties to the dispute.
