1. Eligibility :
An entry to Contest is open to residents of India who are above 18 (eighteen) years of age as of the date of commencement of the Contest as set out in Paragraph 3 below. Entry to participate in Contest is by logging on to filmistaan.in (“Contest Webpage”) and following the steps set out below :
a. Firstly, each entrant shall be required to answer 5 (five) contest questions (“Contest Questions”) based on motion pictures in Hindi language displayed on the Contest Webpage during the Contest Period.
b. Secondly, pursuant to answering the Contest Questions correctly, the entrant shall share the news that the entrant has become eligible for Filmistaan citizenship on Twitter by using the “#Filmistaan” hash tag.
c. Thirdly, pursuant to the completion of step (b) above, the entrant shall upon UTV’s request, provide the following data to UTV : (i) passport size picture, (ii) name (compulsory), (iii) gender (compulsory), (iv) city (compulsory), (v) email i.d. (compulsory), and (vi) phone no. (optional). Upon receipt of such data, UTV shall provide a document containing the aforesaid data (“Filmistaan Passport”) to the entrant.
2. Participation :
Entrants may participate in the Contest and complete steps (a) to (c) set out in Paragraph 1 above during the Contest Period through the response mechanisms as set out in Paragraph 1 above and in the manner as may be required by UTV. Entrants may re-enter response to a Contest Question till the time the entrant gives a correct response. However, the entrant shall be eligible for Filmistaan Passport only upon correctly answering all Contest Questions. Directors, officers and employees of UTV,Shringar Film Private Limited (“Producer”) or any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, sponsors of the Contest, associate vendors and immediate families of each are not eligible to enter the Contest. All applicable federal, state and local laws and regulations apply. Offer/Contest void where prohibited.
3. Contest Period :
The Contest shall be active and valid only from April 18, 2014 to May 15, 2014.
4. Winners :
A maximum of 200 (two hundred) complete and correct entrants who procure a Filmistaan Passport shall be selected by the judges at the end of the Contest Period out of all the entrants who register with UTV during the entire Contest Period on the basis of random selection (“Winners”). Each Winner shall be eligible for :
a. Entry for the Winner and 1 (one) accompanied guest to a special screening of the live action motion picture titled “Filmistaan” (“Picture”) in the Winner’s city or in the event there is no screening in the city where the Winner resides, then at city nearest to the city where the Winner resides (“Prize No. 1”). It is hereby specified that the Winner shall be able to claim Prize No. 1 by presenting the Filmistaan Passport at the venue of the screening of the Picture.
b. In the event, there is a meet and greet opportunity with the principal members of the cast of the Picture in the city where the Winner resides, UTV shall make best efforts to grant such opportunity to the Winner (“Prize No. 2”).
Prize No. 1 and Prize No. 2 shall hereinafter collectively be referred to as “Prize”. The Winners shall be required to furnish such information as required by UTV for the purpose of delivery of Prize.
5. Prize Selection :
The Prize selection for the Contest shall take place at the registered address of UTV. The judges may determine the correctness and validity of the entries of entrants in their sole discretion. The judges’ decision shall be final and binding and no correspondence shall be entered into about the Contest or the judges’ decision(s). It is hereby clarified that the information provided by the entrants on entering the Contest is required to be true and correct and needs to be submitted within the timelines as set out on the Contest Webpage. In the event, the information provided by the entrant is found to be untrue or false, the judges shall have all rights to reject the entry, at their sole discretion.
6. Restrictions and Exclusions for Prize :
The Prize is non-transferable, may not be exchanged for cash. The Prize not claimed within 7 (seven) days after delivery of notification shall be forfeited and awarded to an alternate winner unless otherwise stated. UTV reserves the right to substitute a prize of equal value for the Prize. The Prize is awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). In the event any of the Winners do not accept or agree to the terms as stated herein, the Prize shall remain with UTV who on its sole discretion may offer the same to the next eligible winner.
7. Taxes :
All federal, state and local taxes associated with the receipt or use of any Prize stated hereinabove are the sole responsibility of the Winners.
8. Contest Rules :
The Winners shall be notified by post, email and/or by telephone. To claim the Prize, Winners should follow the instructions contained in their notification. Winner(s) may be required to collect Prize No. 2 from such place and time as notified by UTV in the notification and/or to travel to a place to claim Prize No. 1 and Prize No. 2 Winners shall be solely responsible for any and all costs associated with collection and/or delivery and/or claiming of the Prize including cost of travel and accommodation. UTV accepts no responsibility for any variation in the value of any Prize (or any part of it). By claiming the Prize, Winners hereby agree, to permit to be photographed and/or filmed at the venue for screening of the Picture and/or at the venue for meeting the principal members of the cast of the Picture, for purposes of advertising, publicizing, promoting and/or exploiting the Contest and/or Picture in any and all media.
9. Entrants Information :
At your option, you hereby authorize and consent to the use of your personal or sensitive personal information (“Data”) by UTV including its affiliates, agents, advisors or subcontractors (“Authorized Entities”), for such lawful purposes as may be deemed necessary including for, distribution of any Prize to the Winners, if applicable, pursuant to these Terms & Conditions. You understand and acknowledge that (i) the Data is your personal or sensitive personal information as understood within the meaning of the applicable laws; (ii) you have voluntarily and at your option, agreed to provide the Data to the Authorized Entities for such lawful purposes as may be deemed necessary pursuant to these Terms & Conditions; and (iii) the Data shall or may be transferred by the Authorized Entities including its affiliates, agents or subcontractors, for such lawful purposes as may be deemed necessary pursuant to these Terms & Conditions. The use of the Data by UTV shall be governed by the provisions of the global privacy policy including its addendum as applicable to Indian residents, available at www.utvgroup.com. You agree and accept to be bound by the terms thereof.
10. Disclaimer :
UTV, Producer, Twitter, Inc. (“Twitter”) and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies shall not be responsible for : (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of UTV; and (d) any printing or typographical errors in any materials associated with the Contest.
11. UTV Ownership of Entries :
All entries and materials submitted to UTV in connection with the Contest (collectively, “Entry Materials”), along with all copyright, trademark and other proprietary rights associated therewith, become the property of UTV upon submission, and Entry Materials shall not be returned to any entrant. Without limiting the generality of the foregoing, you acknowledge that UTV shall own all rights to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and non-commercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing, without separate compensation to you or any other person or entity. You agree to take, at UTV’s expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by UTV to effect, perfect or confirm UTV ‘s ownership rights as set forth above in this Paragraph 11.
12. General Release :
By entering the Contest, you indemnify UTV, Producer, Twitter and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the “Indemnified Parties”) from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
13. Use of Winner’s Name, Likeness, etc :
Except where prohibited by law, entry into the contest constitutes permission to use winners’ name, address, likeness and/or Prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, winners may be required to execute consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.
14. Affidavit & Release :
As a condition of being awarded any prize, winners shall be required to execute and deliver to UTV a signed affidavit of eligibility and acceptance of these Terms & Conditions and release of liability.
15. Termination/Suspension :
UTV has the sole right to suspend, postpone, cease, close or terminate this Contest at any given point of time at its sole option and discretion.
16. Copyright Notice :
The Contest and all accompanying materials are copyrighted by UTV. All rights reserved.
17. Miscellaneous :
The Contest and these Terms & Conditions shall be governed, construed and interpreted under the laws of India. Entrants agree to be bound by these Terms & Conditions and by the decisions of UTV, which are final and binding in all respects. UTV reserves the right to change these Terms & Conditions at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant’s participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond UTV’s control affect the administration, security or proper play of the Contest or UTV otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Entrants who violate these Terms & Conditions, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to UTV, the Contest or any other entrant (in each case as determined in UTV’s sole discretion) are subject to disqualification from entry into the Contest. UTV reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
18. Dispute Resolution :
These Terms & Conditions (and any dispute, difference, proceedings or claim of whatever nature arising out of or in connection with these Terms & Conditions) shall be governed by, and construed in accordance with, the laws of India and shall be subject the exclusive jurisdiction of the Bombay High Court.
