Please read these Terms & Conditions before entering the “Castrol Yeh Hai Aashiqui contest” (the “Contest”) to be conducted by Genx Entertainment Limited (“Genx”). By participating in the Contest, you agree to be bound by these Terms & Conditions and represent that you satisfy all of the eligibility requirements set out herein below
Terms & Conditions Of Entry :
1. Eligibility :
The entry to the Contest is open to residents of India and who are 18 (eighteen) years of age or above (“Participants”). Entrants may participate in the Contest in the manner as set out below in Paragraph 2.
2. Participation :
To enter the Contest during the Contest Period, Participant(s) must see the advertisement played on the channel “bindass” (“Channel”) which will mention that the “Channel gives you a chance to meet Rithvik Dhanjani in the city of Mumbai, the host of its Program titled Yeh Hai Aashiqui (“Program”) and shall further direct the Participants to Genx’s website (“Microsite’) The Participant shall then be required to log onto Genx’s Microsite and answer the question(s) asked, upload a photograph of themselves with their motor scooter and submit the information as required by Genx on the Microsite to be eligible as a Participant of the. The following details of the Participants shall be required on the Microsite:
** Name
** Age
** Place of Residence
** email address
** Upload Participant’s photograph as per requirements asked
** Answers the question(s)
Participants may participate in the Contest and submit their response to Genx during the Contest Period through the response mechanism as set out in Paragraph 2 above and in the manner as may be required by Genx. Directors, officers and employees of Genx or any of their respective affiliate companies, subsidiaries, agents, professional advisors, advertising and promotional agencies, sponsors of the Contest, associate vendors and immediate families of each are not eligible to enter the Contest. All applicable central, state and local laws and regulations apply. Offer/Contest void where prohibited.
Contest Period :
The Contest shall be active and valid from March 31st 2014 to April 20th 2014. The Contest shall be running on the Channel from 12.00A.M to 11.59 P.M during the Contest Period, and in order to participate in the Contest, the Participant(s) may enter the Contest by way of the response mechanism as set out in Paragraph 2 above.
Winners :
** Out of all the entries received for the Contest during the Contest Period, only 1 (One) entry shall be selected randomly by the judges at the end of the Contest Period, on the basis of the Participant’s photograph uploaded and the most unique and innovative answers which fulfill the exact requirements as mentioned in the Microsite and such Participant shall be declared as the Winner of the Contest. (“Winner”). The Winner shall get a chance to a meet and greet with
** Rithvik Dhanjani in Mumbai on the sets of the Program, upon the terms as may be set out in the
** notification sent to the Winner (“Prize”). If the Winner is not a resident of Mumbai, Genx shall
** inform the Winner of the travel and accommodation details at the time of notifying the Winner in the manner as mentioned in Paragraph 9 below. The decision of Genx regarding travel and accommodation arramgemenys for the Winner shall be at Genx’s sole discretion and such decision shall be final and binding on the Winner. The Winner shall be required to furnish such information as required by Genx for the purpose of acceptance of the Prize.
Prize Selection :
The Prize selection for the Contest shall take place at the registered office address of Genx. The judges may determine the correctness, quality and validity of the entries of the Participants in their sole discretion. The judges’ decision shall be final and binding and no correspondence shall be entered into about the Contest or the judges’ decision(s). It is hereby clarified that the information provided by the Participants on entering the Contest is required to be true and correct and needs to be submitted within the timelines as set out on this Microsite. In the event, the information provided by the Participants is found to be untrue or false, the judges shall have all rights to reject the entry, at their sole discretion. .The names of the Winner of the Contest may be posted on the Microsite at the discretion of Genx.
Restrictions and Exclusions for Prize :
The Prize is non-transferable, may not be exchanged for cash. The Prize returned as undelivered or otherwise not claimed within 7 (seven) days after delivery of notification shall be forfeited and awarded to an alternate winner unless otherwise stated. Genx reserves the right to substitute a prize of equal value for the Prize. All Prizes are awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). In the event any of the Winners do not accept or agree to the terms as stated herein, the Prize shall remain with Genx who at its sole discretion may offer the same to the next eligible winner.
Taxes :
All central, state and local taxes associated with the receipt or use of any Prize stated hereinabove are the sole responsibility of the Winner. Winner shall be solely responsible for any and all costs associated with acceptance of the Prize.
Contest Rules :
The Winners shall be notified by post, email and/or by telephone. To claim the Prize, Winners should follow the instructions contained in their notification. Genx accepts no responsibility for any variation in the value of any Prize (or any part of it). In the event the Prize Winner is a minor, the parent/legal guardian of such minor shall collect/accept the Prize on behalf of such minor Prize Winner.
Participants Information :
At your option, you (and, if you are a minor, your parents or legal guardian) hereby authorize and consent to the use of your personal or sensitive personal information (“Data”) by Genx including its affiliates, agents, advisors or subcontractors (“Authorized Entities”), for such lawful purposes as may be deemed necessary including for, distribution of any Prize to the Winners, if applicable, pursuant to these Terms & Conditions. You understand and acknowledge that (i) the Data is your personal or sensitive personal information as understood within the meaning of the applicable laws; (ii) you have voluntarily and at your option, agreed to provide the Data to the Authorized Entities for such lawful purposes as may be deemed necessary pursuant to these Terms & Conditions; and (iii) the Data shall or may be transferred by the Authorized Entities including its affiliates, agents or subcontractors, for such lawful purposes as may be deemed necessary pursuant to these Terms & Conditions. The use of the Data by Genx shall be governed by the provisions of the global privacy policy including its addendum as applicable to Indian residents, available at www.bindass.com. You agree and accept to be bound by the terms thereof.
Disclaimer :
Genx, all participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, professional advisors, employees and agencies shall not be responsible for : (a) any late, lost, misrouted, garbled or distorted or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Contest disruptions, injuries, losses or damages caused by events beyond the control of Genx; or (d) any printing or typographical errors in any materials associated with the Contest.
Genx Ownership of Entries :
All entries and materials submitted to Genx in connection with the Contest (collectively, “Entry Materials”), along with all copyright, trademark and other proprietary rights associated therewith, become the property of Genx upon submission, and Entry Materials shall not be returned to any Participants. Without limiting the generality of the foregoing, you acknowledge that Genx shall own all rights to use, modify, reproduce, publish, perform, display, distribute, make derivative works of and otherwise commercially and non-commercially exploit the Entry Materials in perpetuity and throughout the universe, in any manner or medium now existing, without separate compensation to you or any other person or entity. You agree to take, at Genx’s expense, any further action (including, without limitation, execution of affidavits and other documents) reasonably requested by Genx to effect, perfect or confirm Genx’s ownership rights as set forth above in this Paragraph 12.
General Release :
By entering the Contest, you the Winner (and, if you are a minor, your parents or legal guardian) indemnify Genx, participating sponsors and any of their respective parent companies, subsidiaries, affiliates, directors, officers, employees and agencies (collectively, the “Indemnified Parties”) from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.
Use of Winner’s Name, Likeness, etc. Except where prohibited by law, entry into the contest constitutes permission to use winners’ name, address, likeness and/or Prize information, without limitation, for promotional purposes without further permission or compensation. As a condition of being awarded any prize, except where prohibited by law, Winners may be required to execute consent to the use of their name, address, likeness and/or prize information, without limitation, for promotional purposes without further permission or compensation.
Affidavit & Release :
As a condition of being awarded any prize, the Winner shall be required to execute and deliver to Genx a signed affidavit of eligibility and acceptance of these Terms & Conditions and release of liability.
Termination/Suspension :
Genx has the sole right to suspend, postpone, cease, close or terminate this Contest at any given point of time at its sole option and discretion.

Miscellaneous :
The Contest and these Terms & Conditions shall be governed, construed and interpreted under the laws of India. Participants agree to be bound by these Terms & Conditions and by the decisions of Genx, which are final and binding in all respects. Genx reserves the right to change these Terms & Conditions at any time, in its sole discretion without prior intimation, and to suspend or cancel the Contest or any Participants s participation in the Contest should viruses, bugs, unauthorized human intervention or other causes beyond Genx’s control affect the administration, security or proper play of the Contest or Genx otherwise becomes (as determined in its sole discretion) incapable of running the Contest as planned. Participants who violate these Terms & Conditions, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Genx, the Contest or any other Participants (in each case as determined in Genx’s sole discretion) are subject to disqualification from Entry into the Contest. Genx reserves the right to lock out persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
Dispute Resolution :
These Terms & Conditions (and any dispute, difference, proceedings or claim of whatever nature arising out of or in connection with these Terms & Conditions) shall be governed by, and construed in accordance with, the laws of India and shall be subject to the exclusive jurisdiction of the Courts of Mumbai.
